IMPORTANT NOTICE TO PARTICIPANTS:

THESE TERMS AND CONDITIONS CONSTITUTE A PART OF YOUR CONTRACT WITH NOMA TRIBE AND, UPON ACCEPTANCE OF YOUR APPLICATION, GOVERN YOUR PARTICIPATION IN THE NOMA TRIBE RETREATS WHICH YOU ARE INVITED TO JOIN AND CONSTITUTE A BINDING CONTRACT AND TERMS AND CONDITIONS GOVERNING YOUR RIGHTS AND THE RELATIONSHIP BETWEEN YOU AND NOMA TRIBE.

BY JOINING A NOMA TRIBE RETREAT OR USING NOMA TRIBE SERVICES IN ANY MANNER YOU ARE AGREEING TO OUR WAIVER AND OUR PRIVACY POLICY. YOUR SAFETY AND THE PROTECTION OF YOUR DATA IS IMPORTANT TO US. PLEASE REVIEW OUR PRIVACY POLICY FOR MORE INFORMATION ABOUT HOW WE COLLECT, USE AND STORE DATA.

 

1. International Medical Insurance

  • Every Noma Tribe attendee is required to have a form of international medical insurance for emergencies. If it is found that you do not have medical insurance, or have medical insurance that is insufficient, you bear the associated risks.

2. Time frame

  • One month is defined as 4 weeks, beginning on a Sunday and ending on a Sunday (some exception may apply)

  • All credits and retreat passes expire 12 months from the original purchase date, unless explicitly outlined in writing by Noma Tribe prior to the expiration date.

3. Payment

  • To reserve your space on a Noma Tribe retreat a down payment of 30% is required upon commitment to a specific retreat. The down payment is non-refundable, and cannot be transferred for use towards a different retreat. In very few certain extreme situations if Noma Tribe has not accumulated sunk costs, Noma Tribe may waive its strict refund and transfer policies. Waiver of such policies is at Noma Tribe’s sole discretion. While not an exhaustive list, Extreme Situations would not automatically include company denial, visa / passport issues, change in personal circumstance, illness or injury in relation to a pre-existing condition,  illness from COVID-19, illness or injury to a family member or friend.

  • Noma Tribe reserves the right to decline transfer requests if space is not available on the retreat to which you would like to transfer your down payment. You will only be charged the transfer fee if the transfer request is approved.

  • If you are willing to secure your spot, you will pay 30% down payment, the 70% reminder will be made maximum one month before the start of the retreat.  

  • You can pay for your retreat(s) by credit card, bank transfer or Wise. Payments by credit card are subject to a 5% credit card surcharge.

Retreat cost.  

  • The cost to participate in Noma Tribe’s retreats will be provided after the potential participant signs up the website form or during the interview call. Retreat costs are subject to change at any time. Noma Tribe will honor the prices advertised as of the date of a Participant’s non-transferable and non-refundable down payment. In the case that a retreat decreases in price following the initial payment of said retreat, the Participant will not be entitled to any refunds or reductions in future payments.

4. Cancellations

  • If you cancel or shorten a retreat more than 60 days before the intended start, you will receive a full refund of the amount you paid for your retreat. Credit card surcharges are non-refundable.

    If you cancel or shorten a retreat between 40 days and 31 days before the intended start, you will receive a refund of 50% of the paid amount, minus a $100 USD banking and application processing fee.

  • If you cancel or shorten a retreat with less than 30 days before the intended start or after a retreat begins, we cannot issue you a refund.

  • For bookings made more than 15 days before the retreat start date, you may only cancel your space on a Noma Tribe retreat within 24 hours after your reservation and we’ll refund your payment in the payment method of your reservation. Credit card surcharges are non-refundable. Cancellations after this period will have no refund of payments will be made. If your booking is accepted for a retreat due to start 15 days or less from the booking date, then the 24 hour cancellation period is not applicable, and no refund of payments will be made.

  • Refunds are provided only for the reasons listed in these Terms. We will not provide refunds based on a threat of negative reviews or social media posts. We reserve all rights in law and equity to respond to and/or take action against reviews or social media posts that are false, misleading, libelous, harassing, abusive, obscene, vulgar, sexually explicit, or are inappropriate with respect to race, gender, sexuality, ethnicity, or other intrinsic characteristic, or contain confidential information.

  • The payment you make is not transferable to another person nor can your spot on the retreat be filled by anyone besides you.

  • In the unfortunate event that Noma Tribe ceases operations or declares bankruptcy, refunds for products or services purchased will not be issued.

5. Noma Tribe Cancellation of a program 

  • Noma Tribe reserves the right to cancel any retreat that has not yet departed due to inadequate enrollment (minimum 5 participants per retreat) or any other reason that makes the retreat economically infeasible to operate or because of good-faith concerns with respect to the safety, health, or welfare of the participants. If a retreat is canceled prior to departure, Noma Tribe will provide participants with a full refund of monies paid to Noma Tribe; except in the event that the cancellation is due to a significant event that makes it infeasible to operate the retreat as planned, in which case Noma Tribe will only provide a refund of all monies paid in excess of the stated down payment amount for that retreat, and, at Noma Tribe’s option, provide participants with a refund and/or credit toward a future Noma Tribe retreat, equivalent to any remaining monies paid to Noma Tribe. Any credit will be valid for twelve months from the date of issue. Noma Tribe has no responsibility for any expenses, including any non-refundable expenses, incurred by participants in preparing for a canceled retreat or for any additional arrangements should participants embark prior to the scheduled group departure date.

  • Noma Tribe also reserves the right to cancel any retreat in progress because of good-faith concerns with respect to the safety, health, or welfare of the participants. If Noma Tribe cancels a retreat in progress, participants will receive a prorated refund of their payment. Except as outlined above when Noma Tribe cancels a retreat in progress, Noma Tribe has no responsibility for any expenses, including any non-refundable expenses incurred by participants in preparing for a canceled retreat or for any additional arrangements should participants embark prior to the scheduled group departure date, or for arrangements made after the retreat end date.

  • Noma Tribe also reserves the right to delay the commencement of a retreat for reasons including, but not limited, to travel and/or quarantine restrictions, health and safety concerns, the closure of hotels, restaurants and other businesses due to lockdown restrictions and other similar events. In such an event, Noma Tribe shall contact retreat participants regarding the alternative launch dates.

  • Under certain circumstances, Noma Tribe may need to interrupt a current retreat due to travel and/or quarantine restrictions, health and safety concerns, the closure of hotels, restaurants and other businesses due to lockdown restrictions and other similar events. In such event, while Noma Tribe will use reasonable efforts to mitigate the impact of such an interruption, you will be responsible for all additional costs associated with the interruption, including, without limitation, any additional travel, accommodation and food and beverage costs although you may be able to seek reimbursement for some of these costs from any travel insurance policies you may have obtained.

6. Invoices 

  • Payments for certain retreats will be auto-charged via third party payment processors.

  • Retreat invoices, down payment invoices, as well as invoices for other additional services provided or facilitated by Noma Tribe may be sent and due upon commitment to said service. Noma Tribe utilizes third party billing platforms, including but not limited to Stripe, to send and track monthly invoices and to facilitate payments.

7. Discounts, Promotions and Incentives 

  • Noma Tribe, at its sole discretion, may offer discounts and/or promotions for certain products or offerings. Any discounts or promotions offered are non-transferable and their advertised timelines are strict. Noma Tribe reserves the right to deny the usage of discount codes that are not used as instructed. (E.g. If a single participant uses a discount code for couples, Noma Tribe will not honor that discount code.)

  • Combined discounts or incentives may not be applied to the same booking, unless at Noma Tribe’s sole discretion.

  • Retreats discounted with a Noma Tribe promotion can be purchased with Noma Tribe credit, if the credit was acquired from Noma Tribe deferring a retreat.

  • Credit acquired from a customer canceling their booking cannot be used towards discounted retreats.

  • Noma Tribe reserves the right to withdraw any participant incentive offers (e.g. Refer a Friend) without notice at any time, for any period of time.

  • Noma Tribe credit is valid for the term stipulated at issuance, or until the date of expiry on the credit. If an expiration term is not given at the time of issuance then it is valid for two years.

8. Travel refunds

During the retreat, no flight or other travel costs incurred by participants will be reimbursed by Noma Tribe. Arriving late or leaving a retreat in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of a retreat. Neither Noma Tribe, nor its designated members or affiliates, shall be liable for any cancellation penalty charged by an air carrier or other transportation provider, including but not limited to, any air carrier's cancellation penalty related to the purchase of a non-refundable ticket to or from the city a participant is in prior to joining the retreat or the city a participant is going to after leaving the retreat.

9. Damage to Property

  • You are financially responsible for any property you or your guests damage or break in the Noma Tribe coliving, hostel, hotel or coworking space during your stay with us.

10. Sharing a Room

  • If you plan to have a non-Noma Tribe guest stay in your accommodation, there is an occupancy charge that is assessed to each night of your guest’s stay, generally between 30-45 USD per night based on location. Guest stays may not exceed 5 days.

  • If you plan to travel with a guest who will not be on the retreat and whose stay would exceed 5 days, please let us know so that we can evaluate pricing on a case-by-case basis.

  • If your guest is a participant, we charge a retreat fee (~roughly 25% of your accommodation and 100% for services and tours included) for the additional participant if you are sharing a room.

11. Personal Responsibility

  • Noma Tribe helps guests find hotels and coworking spaces to work from. Beyond this, participants are responsible for their own health, safety, and security while traveling. Noma Tribe provides travel advice and warnings but does not accept any responsibility for guests’ safety and security. Participants are liable for their own safety and security, including purchasing their own medical travel insurance and vaccinations.

12. Photo & Data Permissions

  • By attending Noma Tribe retreats, you consent to your voice, name, personal information, and/or likeness being used, without compensation, in films and tapes in any and all media, whether now known or hereafter devised, in perpetuity, and you release Noma Tribe, its successors, assigns and licensees from any liability whatsoever of any nature. Moreover, any postings of photos or images on the Noma Tribe media channel or Noma Tribe shared google photo album irrevocably assigns to Noma Tribe and its successors, in perpetuity, all rights to use the photos anywhere in the world and in any medium (whether now known or hereinafter invented). Noma Tribe will take down immediately after express notice to Noma Tribe, any media you’re included in if you don’t find it acceptable.

13. Acceptable Behavior

  • In order to maintain a safe, welcoming and inclusive community, Noma Tribe reserves the right to terminate the stay and membership of participants at any time, for reasons including but not limited to:

    • Illegal Acts – if a participant breaks the law of the country they are in.

    • Local Relations – if a participant behaves in an unkind or offensive way towards our host, including but not limited to hotel and coworking staff.

    • Reckless Acts – if a participant willingly or unwillingly acts in a way that puts themselves or other participants in an unreasonable amount of danger.

    • Community Behavior – if a participant is repeatedly reported on by other participants, or if the participant behaves in a negative and rude way towards other participants.

    • Weapons – No weapons are allowed on any Noma Tribe programming, including at the accommodation, at the workspace or on experiences.

  • Noma Tribe has full authority to decide if one of these acts or behaviors has taken place at its sole discretion. If a participant’s stay and membership has been terminated, it will be treated as a retreat Cancellation and standard retreat Cancellation terms apply (term 4).

14. Force Majeure

  • In no event shall Noma Tribe be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, pandemics, nuclear or natural catastrophes or acts of God, and interruptions, loss or malfunctions of utilities, communications or computer (software and hardware) services.

15. Changes to the T&Cs

  • These terms and conditions are subject to change without notice. Upon update, the new terms and conditions shall apply and be effective immediately upon inclusion/publication of such changes on official Noma Tribe channels. 

16. Jurisdiction

  • These terms and conditions shall be governed by and construed according to the laws of the State of Wyoming and in the event of any dispute arising out of or in connection with these terms and conditions including any question regarding their existence, validity or termination, the parties shall at first instance take reasonable efforts to settle and resolve such disputes in good faith and in an amicable manner by negotiation, failing which any such dispute shall be heard exclusively by the Wyoming courts

Noma Tribe Retreat Policies

  1. Pets in some locations, namely where we have confirmed that Selina will be the accommodation provider, we may be able to permit pets to be on retreats with their owner. Any additional costs charged in relation to bringing pets will be payable by the Participant direct to the Accommodation Provider. Noma Tribe is not responsible for any additional charges, or services in relation to the charges. Nor can Noma Tribe take any responsibility for the accomodation’s suitability for pets.The Participants will be responsible for upholding all regulations laid out by the Accommodation provider.

  2. Age Persons below the age of 21 are not eligible to participate in a Noma Tribe retreat.

  3. Drugs and Illicit Substances Noma Tribe does not tolerate use of illegal drugs or activity on any retreat. All Participants are expected to abide by the laws in each country visited. If at any point during the retreat you perform or engage in any illegal activity, Noma Tribe is not responsible for legal ramifications of that action, and you may be removed from the retreat at your own cost, and without refund to you. Noma Tribe has no responsibility or obligation to notify Participants of all applicable local laws.

  4. Noma Tribe Participants are responsible for obtaining any documents required for their participation in Noma Tribe Services, such as a valid passport, all visas, vaccination certificates, and any other documents. Failure to obtain documents does not negate the Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the Participant’s responsibility. Noma Tribe is not a legal advisor or a professional advisor and it does not provide guidance on visa processes.

  5. By participating in a retreat, unless living in ‘Private Accomodation’ each Participant is agreeing to share their accommodation with other Participants. In doing so, each Participant acknowledges to share the accommodation respectfully. Respect extends to, and not limited to: working patterns, sleeping patterns, cultural differences, personal boundaries, sexual orientation, gender identity. As per Noma Tribe Code of Conduct, no discrimination or harassment will be tolerated at any time.

  6. Noma Tribe is not responsible for assigning bedrooms within the accommodation, nor will act on any feedback that a Participant is not content with the bedroom assigned by another housemate(s) in comparison to the other bedroom(s).

  7. By agreeing to share accommodation provided by Noma Tribe, as part of a retreat, each Participant acknowledges and accepts the accompanying increased risk of contracting or passing an illness from other Participants.

  8. Our Housing Promise.

    Noma Tribe will never knowingly or intentionally put a Participant in accommodations we believe are “unlivable”. However, sometimes situations arise that are out of our control. If any of the issues listed below arise, please report them immediately to your community host. If the issue is not resolved within 48 hours of your report, and if the issue was not the direct or proximate result, Noma Tribe will move you to a new accommodation until the problem has been fixed.

    The following instances are included in and examples of this policy:

    • Electricity or power outage: Intermittent power outage resulting in 48 hours of total lost power. Note: the outage must be specific to the building or the unit in order to qualify.

    • No internet connectivity: Note: Noma Tribe may provide you with a SIM card or hotspot instead of moving you for internet connectivity issues.

    • Clean room and/or bedding at check in. 

    • Air conditioning or heat failure in extreme climates. Extreme Climates are defined as follows: Warm Weather: If the average temperature* in a city during the month that we are there is greater than 79 F (26 C), you will have air conditioning in your accommodation. Cold Weather: If the average temperature* in a city during the month that we are operating is less than 50 F (10 C), you will have a heater in your accommodation. Some exceptions may apply and Noma Tribe will inform you beforehand.
